This End User License Agreement (the "Agreement") is entered into between Roof Gutter Design Pty Ltd, an Australian company, and the end user ("User").
1.1 Software: Refers to the software provided by Roof Gutter Design Pty Ltd, including any updates or supplements.
1.2 User: Refers to the individual or entity that has obtained a license to use the Software.
2.1 Scope of License: Roof Gutter Design Pty Ltd grants the User a non-exclusive,
transferable license to use the Software for its intended purpose in accordance with the terms of this Agreement.
the User may add this license to all required devices.
On doing so the program will detect a new user, and request an email address for which to send a new activation code.
The new user will be subject to this EULA, and the license expiry time of the original Buyer.
2.2 Restrictions: The User shall not sub license, sell, lease, rent, or otherwise transfer the Software to any third party. The User shall not modify, reverse engineer, decompile, or disassemble the Software.
3.1 Ownership: Roof Gutter Design Pty Ltd retains all right, title, and interest in and to the Software, including all intellectual property rights.
3.2 Copyright: The Software is protected by copyright laws and international copyright treaties.
4.1 As-Is: The Software is provided "as is," without warranty of any kind, either expressed or implied.
It is the users responsibility to use the programs for their intended purpose, and to enter the correct data in the correct locations.
If the user intends using the calculation "printout", it is the users responsibility to sign this document if required.
Roof Gutter Design Pty Ltd assumes the user has the necessary qualifications to do this.
The User should do a few calculations using the graphs in AS/NZS 3500.3 to satisfy himself that the program gives the same results as this Standard.
4.2 Limitation of Liability: Roof Gutter Design Pty Ltd shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the Software.
5.1 Termination: This Agreement is effective until terminated. Roof Gutter Design Pty Ltd may terminate the license at any time for breach of this Agreement.
6.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Queensland, Australia.
7.1 Entire Agreement: This Agreement constitutes the entire agreement between Roof Gutter Design Pty Ltd and the User.
7.2 Amendments: Roof Gutter Design Pty Ltd may amend this Agreement at any time by providing notice on its website.
By using the Software, the User agrees to be bound by the terms of this Agreement.
